By using SwimCapz.com and purchasing products from SwimCapz.com you understand and agree to abide by the terms and conditions detailed within it.

The Buyer shall indemnify and hold harmless the Producer from any and all loss, cost, expense and damages on account of any and all manner of claims, demands, actions and proceeding that may be instituted against the Producer on grounds alleging that the said printing violates any copyright or any proprietary right of any person, or that it contains any matter that is libelous or scandalous, or invades any person's right to privacy or other personal rights, except to the extent that the Producer has contributed to the matter. The Buyer agrees to, at the Buyer's own expense, promptly defend and continue defense of any such claim, demand action or proceeding that may be brought against the Producer, provided that the Producer shall promptly notify the Buyer with respect thereto, and provided further that the Producer shall give to the Buyer such reasonable time as the exigencies of the situation may permit in which to undertake and continue the defense thereof.

All orders are final. Orders may not be canceled, altered or suspended.

We reserve the right to cancel any order that we deem is an invasion of privacy, is degrading, unlawful, profane, obscene or pornographic, or tends to ridicule or embarrass.

We offer two types of shipping: Standard and Next Day Rush. Standard shipments should arrive within 3 to 7 business days after caps are printed. Next Day Rush shipments should arrive within 1 to 3 business days. Products are ready to ship 8 - 21 days after order is placed.

We are not responsible for delays in delivery by FedEx for reasons of their choosing (e.g. adverse weather conditions, customs inspection). Refunds will not be offered if FedEx does not meet their delivery responsiblities.

The appropriate and legal use of all intellectual property of the Producer, and others is required under this Agreement. Unless otherwise indicated on the Web site, all images, designs, icons, logos, photographs and other materials that appear on this Web site are copyrights, trademarks and trade dress and/or other intellectual properties owned, controlled and/or licensed by the Producer.

You agree to not use this Web site or service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar obscene, libelous, invasive of another's privacy, hateful, or racially, ethically or otherwise objectionable. You agree not to use this Web site or service to create any material that infringes on any patent, trademark trade secret, copyright or other rights of any third party.

The products created using images from this Web site are not the exclusive property of the customer. As such the products should not be resold commercially without the written approval of the Producer. The Producer specifically retains the right to display all designs created on the Web site and to resale the same to other customers.

We have the sole right to reject any order that we consider unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of privacy, hateful, or racially, ethically or otherwise deemed objectionable in our sole discretion.

SwimCapz Inc recognizes that you have a right to privacy, and we will not give or sell anyone specific information about you or any orders you have placed through the SwimCapz.com except that: (i) SwimCapz may share information about you or an order that you have placed with a relevant Institution in order to allow such Institution to review the use of the Licensed Marks as necessary; (ii) SwimCapz may provide information about you and your order to its subcontractors; and (iii) SwimCapz may share information about you with its marketing partners and affiliates for purposes of marketing SwimCapz.

SwimCapz employs third party cookies which are used to target customers for advertising purposes. SwimCapz Inc. will not send you unsolicited materials except that customers may receive occasional e-mails to announce changes in the SwimCapz service, new features and technical updates.
